- The guarantee provided by France on 25 March 2004 in connection with the construction by AREVA NP of a nuclear power station for Teollisuuden Voima Oy does not constitute aid within the meaning of Article 87(1) of the Treaty.
- The UK authorities recalled the arguments presented in the notification according to which the aid has no impact on the competition structure since it has no impact on BE’s short run marginal costs which determine the day-to-day operations of a station.

- In the action brought against Commission Decision 2003/293/EC, the Association of Service Station Managers of Madrid (Asociación de Empresarios de Estaciones de Servicio de la Comunidad de Madrid) and the Catalan Federation of Service Stations (Federación Catalana de Estaciones de Servicio) plead, in substance, that the Commission infringed Article 107(1) of the TFEU, in so far as it affirms in the contested Decision that the disputed measures do not constitute State aid as they do not confer any advantage on agricultural cooperatives and are in keeping with the nature and scheme of the cooperative tax system.
- For the same reason, aid should be granted only for the storage of products in frozen condition, of sound and fair merchantable quality and of Community origin as defined by Commission Regulation (EEC) No 2454/93 of 2 July 1993 laying down provisions for the implementation of Council Regulation (EEC) No 2913/92 establishing the Community Customs Code [5], with a level of radioactivity not exceeding the maximum levels permitted under Council Regulation (EEC) No 737/90 of 22 March 1990 on the conditions governing imports of agricultural products originating in third countries following the accident at the Chernobyl nuclear power station [6].
